The meeting of the Franklin Planning Commission was held on Monday, March 10, 2008, and called to order at 5:35 P.M. by Chairman Terry Lennon.

The pledge of allegiance was led by Mr. James Mears.

Motion to approve the minutes of the January 28, 2008 meeting was made by Mr. Lukas, seconded by Mr. Mears.

Chairman Lennon at this time recognized Judge Ruppert and stated the Judge wished to address Planning Commission on questions they had raised at the January meeting. The two properties questioned at the meeting, 521 South Riley and 540 South Main, had indeed been cited to Court by NIC, with 521 being continued since no representative of NIC was available and 540’s owner fined and all repairs certified complete by NIC. Planning Commission thanked the Judge for his timely report.

The oath or affirmation was administered by the Law Director at this time to all members of the audience who anticipated addressing Planning Commission this evening. Those taking the oath were Mr. Wannenberg, Mr. Acton and Mr. Mooney.

New Business: PUBLIC HEARING PC 08-04 Interim Development Control Overlay District,
State Route 123, nine month extension.

Chairman Lennon opened the Public Hearing.

Mr. Woods stated the State Route 123 Interim Development Control Overlay District had been established, for three months, by City Council at its February meeting and this was simply an extension of that District for a period of nine months. Mr. Woods then introduced Mr. Robinette, who summarized the Interim Development Control Overlay Ordinance 1158, and the initial Resolution setting the IDC areas and enforcement period of ninety days. The City needs an additional nine months of enforcement to insure the IDC is in effect for the period the City is reviewing the Comprehensive Plan and the Zoning Ordinance. There being no questions for Mr. Robinette from the Commission, Chairman Lennon opened the public hearing.
Mr. Wannenberg, agent for Schuemacher- Dugan, developer of Franklin Interstate Business Park, stated they have owned the Park for approximately 11 years and no one would consider them overly active in developing this property. Mr. Wannenberg does feel that the IDC adds an additional layer of bureaucracy to the process and makes its more difficult to market the property. Mr. Wannenberg then requested that the M-1 zoned property be removed from the IDC to make it more attractive and easier to market the Franklin Interstate Business Park.
Mr. Robinette addressed this comment stating it would be a change to the zoning code and not to this extension by removing M-1 from the IDC.

With no further discussion, Chairman Lennon closed the public hearing.

Chairman Lennon then requested a motion to hear the State Route 73 IDC before a vote on this case.
Ms. Fisher informed Planning Commission that we would need a separate vote per Public Hearing and that one case should not influence the other case.
Mr. Lipps then made the motion to table PC 08-04, seconded by Mr. Dunlap.

PUBLIC HEARING PC 08-05 Interim Development Control Overlay District,
State Route 73, nine month extension.

Chairman Lennon opened the public hearing.

Mr. Robinette stated that, unless he had to, there was no additional information to be supplied other than this extension was for the State Route 73 IDC district. Chairman Lennon now opened the public hearing.

Mr. Acton, agent for 1221 and 1223 East Second Street and 30 Deardoff Road, wished to echo Mr. Wannenberg’s comments and asked for clarification on the notification process for public hearings. His biggest perceived fear was that there would be a zoning change without property owner input and the unknowns within the IDC.

Commission members, Mr. Mears, Mr. Dunlap, and Ms. Tucker, tried to reassure Mr. Acton that the purpose of the IDC was to promote development that enhanced his properties and at the same time enhanced the City gateways.

With no further discussion, Chairman Lennon closed the public hearing.

Motion to recommend approval of PC 08-05, Interim Development Control Overlay District, State Route 73, nine month extension, as presented was made by Mr. Mears and seconded by Ms. Tucker.

Motion to untable PC 08-04, Interim Development Control Overlay District, State Route 123, nine month extension, was made by Mr. Mears and seconded by Mr. Dunlap.

Motion to recommend approval of PC 08-04, Interim Development Control Overlay District, State Route 123, nine month extension, with M-1 zoned properties eliminated, was made by Mr. Mears did not receive a second.

Motion to approve PC08-04, Interim Development Control Overlay District, State Route 123, nine month extension, as presented was made by Mr. Lukas and seconded by Ms. Tucker.
