The meeting of the Franklin Planning Commission was held on Monday November 08th, 2010 at the Franklin Municipal Building. The meeting was called to order at 5:34 p.m. by Chairman Mr. David Hopper.

Also present: Ms. Donnette Fisher, City Law Director; Mr. Don Woods, Chief Zoning Official; Mr. Jason Hall, P.E., Prism Engineering representing Boral Bricks; Mr. Gary Lust

The pledge of allegiance was led by Mr. John Robinson.

Motion to approve the minutes of the September 27, 2010 meeting made by Mr. Mears, seconded by Mr. Bray.

The oath or affirmation was administered to Mr. Gary Lust and Mr. Jason Hall.

Old Business: PC-10-02 Conditional Use Permit 440 Conover Drive.

This item was added to the agenda per request of Mr. Gary Lust. Mr. Don Woods advised that the conditional use permit was approved on August 30, 2010 by Planning Commission.

Mr. Gary Lust was present at the meeting and advised Planning Commission that he is proceeding with the upgrades to the building and the project is doing great. Mr. Lust stated that the EFIS is up and the building is painted. He stated that the water problem in the southwest corner of the building is not solved. He asked for permission to delay the date for item #10 and #12 of the conditional approval. Item #10 is an awning will be installed over the main entrance, the awning to be of the type shown in Exhibit A, the awning was to be installed by November 15, 2010. Item #12 was landscaping shall be installed as shown on the landscaping plan and was also due to be installed by November 15, 2010. Mr. Lust asked for a delay in the completion date of the landscaping until April 30, 2011.

After discussion, motion to approve delaying the installation of the awning until December 31, 2010 and delay the installation of the landscaping until April 30, 2011. The motion was made by Mr. Mears, and seconded by Mr. Dunlap.

New Business: Public Hearing PC-10-10
B&C Properties 30045 FM 2978, Magnolia, Texas 77354, requests a major site plan to allow the construction of a new 6,000 square foot sales warehouse building at 250 Industrial Drive, Franklin Ohio 45005.

Mr. Hopper opened the public hearing.

Mr. Don Woods, Chief Zoning Official advised that approval of the site plan would allow for the construction of a 6,000 square foot building along with 44,205 square feet of outside storage for r the sale of building materials. He stated that the lot was created from four lots that were consolidated into two lots. The lots were sold by R.L. Drake Company to Boral Bricks.

Mr. Woods advised that the TRC (Technical Review Committee ) met a few times regarding the site plan and that the Engineer of record submitted revised drawings from the October 28, 2010 meeting. Mr. Woods advised that a berm is being installed along Industrial Drive and foundation landscaping plants planted as requested. Mr. Woods advised that the landscaping is adequate. Mr. Woods also added that no parking lot lights are proposed for the site. Mr. Woods advised that the TRC felt that the applicant met requirements.

Mr. Denny Centers began discussion regarding the gray steelox panels on the side elevations. Mr. Jason Hall, P.E. of Prism Engineering advised Planning Commission that the building would have veneer of the front side of the building. Mr. Woods suggested incorporating another type of brick veneer on the building front. Discussed was the visible left side of the building being veneer instead of metal.

Mr. Woods advised that the parking requirements are met.

Discussion then began regarding what building materials were appropriate for the building, veneer vs. metal. Ms. Donnette Fisher, City Law Director suggested using two colors of brick on the front side of building.

After much discussion of the building materials, consensus was reached that the exterior facade design standards under UDO Chapter 1115.08 (h) (3) (A) were not met as presented. Consensus was the color of the siding on the left, right and rear elevations must be a color that compliments the brick on the front elevation and not the gray color as shown.

Motion made by Mr. Dunlap to approve site plan with the condition that the front facade of the building contain two colors of brick and the two sides of the building complement the brick on the front elevation, applicant is to return to Planning Commission with the color samples at the December 13, 2010 meeting. Motion was seconded by Mr. Bray.

PUBLIC HEARING-PC-10-11
The City of Franklin requests amendments, corrections to UDO Chapters 1105.04, 1105.06, 1109.02, 111107, 1113.01, 1113.03, 1113.04, 1113.06. 1115.07, and 1115.08.

Chairman Hopper opened the public hearing. Ms. Donnette Fisher, City Law Director went over the changes and minor corrections to the Unified Development Ordinance. She stated some of the changes were minor typographical errors to the recently adopted updated code.

After discussion of the changes, motion to recommend approval to Franklin City Council for adoption made by Mr. Mears, seconded by Mr. S. Centers.
